Terms and conditions of sale

These terms apply to every order placed with Tarnfell through this website. Please read them before you buy. Our registered company name, company number, place of registration, registered office and contact email appear in the footer of every page of this website and form part of these terms.

1. Who we are

Tarnfell is a retailer of outdoor wellness equipment, operating as a limited company registered in England and Wales and trading from Lincolnshire. We buy from manufacturers and sell directly to you. We receive no commission, referral fee or payment for placement from any manufacturer.

2. How a contract is formed

Placing an order is an offer to buy. Our acknowledgement of your order is not acceptance. A contract is formed only when we send you an order confirmation, or dispatch the goods, whichever happens first.

We may decline an order, and will tell you promptly and refund any payment in full, where the goods are unavailable, where there has been a pricing or description error, or where we have concluded after discussing access with you that we cannot deliver safely to your address.

3. Descriptions, specifications and images

We take product specifications from the manufacturer and check them before publication. Dimensions and weights are given as accurately as we can and small manufacturing tolerances are normal. Timber is a natural material: variation in grain, colour and knots is a characteristic and not a defect, and untreated species weather and silver outdoors over time.

Images are representative. Where an image shows an optional accessory or a different finish we say so.

4. Price and payment

Prices are in pounds sterling and include VAT where applicable. Delivery to mainland Britain is included in the price. Deliveries to the Scottish Highlands and Islands, Northern Ireland, the Isle of Man and the Channel Islands are quoted individually before you order.

Payment is taken at checkout through a certified payment provider. Card details are encrypted and never held on a Tarnfell system.

If we discover an error in the price of goods you have ordered, we will contact you to ask whether you wish to continue at the correct price or cancel. We will not simply process the order at the higher price.

We do not offer, arrange or promote consumer credit.

5. Delivery

Lead times are stated on each product page and quoted as honestly as we can. We will tell you promptly if a lead time changes.

Delivery is kerbside as standard. Where placement or installation is offered by the manufacturer, this is stated on the product page and arranged at the time of order.

Because this equipment is large and heavy, we will agree access with you before dispatch, including vehicle access, route width and height, ground conditions and steps. You are responsible for the accuracy of the information you give us about access, and for having a suitable, prepared base ready before delivery.

Risk in the goods passes to you on delivery. Ownership passes when we have received payment in full.

Please inspect goods before the driver leaves and tell us of any visible damage the same day.

6. Cancellation, returns and refunds

Your right to cancel within 14 days, the return process, refund timescales and your rights if goods are faulty are set out in full in our return and refund policy, which forms part of these terms.

7. Warranty and aftercare

Products carry the manufacturer's warranty, the term and scope of which is stated on each product page. We administer warranty claims on your behalf rather than referring you to the manufacturer.

Manufacturer warranties are in addition to your legal rights under the Consumer Rights Act 2015 and do not replace them.

8. Installation, safety and suitability

Electrical installation must be carried out by a suitably qualified person in accordance with the manufacturer's requirements and applicable regulations. Bases and foundations are your responsibility unless we have agreed otherwise in writing.

Planning permission and building regulations are your responsibility. We will share what we know, but we are not planning consultants and you should confirm requirements with your local authority.

Heat and cold immersion are not suitable for everyone. If you are pregnant, have a heart condition, high or low blood pressure, or any other relevant medical condition, take medical advice before use. Follow the manufacturer's safety instructions, and never use this equipment under the influence of alcohol.

9. Our liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.

We do not exclude or limit our liability in any way where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or for breach of your legal rights in relation to the goods.

We are not liable for business losses. We supply goods for domestic and private use, and if you use them for any commercial or business purpose we have no liability for loss of profit, loss of business, business interruption or loss of business opportunity.

10. Events outside our control

We are not liable for delay or failure to perform caused by events beyond our reasonable control. If such an event occurs we will contact you as soon as possible, and you may cancel and receive a refund for goods not delivered.

11. Your personal data

We handle personal data in accordance with our privacy policy and UK data protection law.

12. Complaints and disputes

If something has gone wrong, email us first and give us the chance to put it right. We aim to acknowledge complaints on the same working day and to resolve them within ten working days, telling you where we are if it will take longer.

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, save that if you live in Scotland or Northern Ireland you may also bring proceedings in your own courts.

13. Changes to these terms

We may amend these terms from time to time. The version that applies to your order is the version published on this website at the moment you placed it.
